Fuel Delivery Service Terms & Conditions

These Terms & Conditions govern the use of mobile fuel delivery services provided by Tank’d LLC (“Company”, “we”, “our”, or “us”). By scheduling, purchasing, or receiving fuel delivery services, the customer (“Customer”, “you”, or “your”) agrees to the following terms.

1. Customer Responsibility for Fuel Selection

Customers are solely responsible for selecting the correct fuel type for their vehicle or equipment.

By placing an order, the customer confirms that the selected fuel type complies with the vehicle or equipment manufacturer’s fuel requirements.

Tank’d LLC shall not be responsible for any damage, repairs, mechanical failure, or losses resulting from incorrect fuel selection provided by the customer at the time of order.

Once fueling begins, the service is considered authorized and accepted by the customer.

2. Vehicle and Equipment Condition

By scheduling service, the customer confirms that:

• The vehicle or equipment is in normal operating condition
• The fuel system is functional and free of defects
• The fuel tank is capable of safely receiving fuel

Tank’d LLC provides fuel delivery services only and does not perform mechanical inspections, diagnostics, or vehicle assessments.

Tank’d LLC shall not be liable for mechanical issues, fuel system failures, leaks, or malfunctions unrelated to the fueling process.

3. Fuel Source and Quality

Fuel delivered by Tank’d LLC is sourced from commercial fuel suppliers and retail fueling stations that meet applicable industry standards.

Tank’d LLC does not manufacture or refine fuel and cannot guarantee vehicle performance, fuel economy, emissions output, or engine operation after fueling.

Any concerns regarding fuel quality must be reported within 24 hours of delivery.

4. Service and Logistics Fee

All orders include a service and logistics fee which covers operational costs including but not limited to:

• Dispatch and scheduling
• Transportation of fuel
• On-site fueling services
• Equipment usage
• operational compliance and safety procedures

The service/logistics fee is separate from the cost of fuel.

Service fees are non-refundable once a technician has been dispatched or service has been performed.

Additional charges may apply for:

• Extended travel distances
• After-hours service
• Emergency requests
• Special equipment requirements

5. Vehicle Accessibility

Customers must ensure the vehicle or equipment is safely accessible at the location provided during booking.

Tank’d LLC reserves the right to refuse or cancel service if:

• The vehicle cannot be safely accessed
• The fueling location presents safety hazards
• The vehicle cannot be positively identified
• Weather or site conditions make fueling unsafe

If our technician arrives and cannot complete the service due to access issues or incorrect information, a failed service attempt fee may be charged.

6. Environmental and Spill Responsibility

Customers are responsible for ensuring that their vehicle or equipment is free of leaks or defects that could cause fuel spills.

Tank’d LLC shall not be responsible for spills caused by:

• damaged or leaking fuel tanks
• defective fuel systems
• improperly modified vehicles
• environmental conditions beyond our control

Customers may be responsible for cleanup costs, environmental remediation, or property damage resulting from vehicle defects or unsafe conditions at the service location.

Tank’d LLC follows standard fuel handling safety practices but cannot guarantee prevention of all environmental incidents resulting from equipment defects or customer property conditions.

7. Property Damage and Site Conditions

Fueling may occur on private property including driveways, parking lots, and job sites.

Customers confirm that the service location is safe and appropriate for fueling operations.

Tank’d LLC shall not be responsible for:

• existing property damage
• surface staining or discoloration caused by pre-existing conditions
• site hazards outside of our control

8. Service Concerns and Claims

If a customer believes there is an issue related to a delivery, the customer must notify Tank’d LLC within 24 hours of the completed service.

Customers agree not to authorize repairs, towing, or mechanical work related to the alleged issue until Tank’d LLC has been given the opportunity to review the service details.

Failure to notify within the required timeframe may limit our ability to investigate or resolve the matter.

9. Delivery Records and Documentation

For operational accuracy, regulatory compliance, and quality assurance, Tank’d LLC maintains service records including but not limited to:

• fuel type delivered
• fuel quantity
• delivery time and location
• vehicle identification details when available
• photographs documenting the fueling process

These records may be used for internal review, dispute resolution, compliance verification, and fraud prevention.

10. Payment Authorization

By placing an order, the customer authorizes Tank’d LLC to charge the payment method provided for:

• fuel delivered
• service/logistics fees
• applicable taxes
• additional service charges if applicable

Customers agree not to initiate a payment dispute or chargeback without first contacting Tank’d LLC to resolve the matter.

Unauthorized chargebacks may result in additional administrative fees and suspension of future services.

11. Cancellation Policy

Orders may be canceled prior to technician dispatch without penalty.

Once a technician has been dispatched, a dispatch or service fee may apply.

If a customer cancels after arrival or during service, the service fee remains non-refundable.

12. Limitation of Liability

To the fullest extent permitted by law, Tank’d LLC, its owners, employees, contractors, and affiliates shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from fuel delivery services.

This includes but is not limited to:

• vehicle damage claims
• mechanical failures
• lost time or business interruption
• towing or repair costs

Any claim related to fuel delivery services shall be limited to the amount paid for the specific service in question.

13. Right to Refuse Service

Tank’d LLC reserves the right to refuse service for any reason including but not limited to:

• unsafe conditions
• suspected fraud
• abusive behavior toward staff
• non-payment or repeated chargebacks

14. Misfueling Acknowledgment and Liability Waiver

By placing an order for fuel delivery, the Customer acknowledges that the fuel type selected during the ordering process is accurate and appropriate for the vehicle or equipment being serviced.

Tank’d LLC relies solely on the fuel type selected by the Customer when fulfilling an order. The Customer understands that Tank’d LLC does not determine the correct fuel type for each vehicle and does not perform mechanical inspections or fuel compatibility verification prior to fueling.

In the event that an incorrect fuel type is selected by the Customer and delivered as requested, the Customer agrees that Tank’d LLC shall not be responsible for any resulting vehicle damage, mechanical failure, repair costs, towing expenses, or related losses.

The Customer further acknowledges that once fueling begins, the service is considered authorized and accepted, and responsibility for the accuracy of the fuel selection remains with the Customer.

Tank’d LLC maintains delivery documentation including fuel type, delivery location, timestamps, and photographic records which may be used to verify service details in the event of a dispute.

15. Agreement to Terms

By scheduling or receiving fuel delivery service, the customer acknowledges that they have read, understood, and agree to these Terms & Conditions.
